This Privacy Policy describes how HopeGuard Restoration LLC (“HopeGuard,” “we,” “us,” “our”) collects, uses, shares, and protects personal information in connection with our website at callhopeguard.com and the restoration and related services we offer in Delaware, Maryland, and Pennsylvania. It also describes the privacy choices available to certain residents and how to exercise them.

1. Information We Collect

a. Information You Provide Directly

When you request a quote, schedule service, or otherwise contact us through our web forms, online chat, phone, or text messages, we may collect your name, mailing and service address, phone number, email address, details about the property or damage, photographs you submit, insurance information (if you choose to share it), and any other information you provide.

b. Information Collected Automatically

When you visit the Site, we and our analytics and advertising partners automatically collect certain information using cookies, web beacons, pixels, and similar tracking technologies, including your IP address, device and browser type, pages viewed, referring and exit pages, approximate location derived from your IP address, and your interactions with our ads and Site content.

c. Information from Other Sources

We also maintain information about your service history and communications with us through our customer relationship management (CRM) and field-service management systems as we schedule, dispatch, and complete work for you.

2. How We Use Your Information

We use the information we collect to:

  • Respond to quote, estimate, and service requests;
  • Schedule and dispatch technicians and manage active and completed jobs;
  • Communicate with you about appointments, arrival windows, and service updates, including by text message where you have opted in;
  • Process payments and maintain business, tax, and warranty records;
  • Operate, maintain, and improve the Site, including through analytics;
  • Deliver, measure, and personalize advertising for our services;
  • Comply with legal, insurance, licensing, and regulatory obligations; and
  • Protect against fraud, unauthorized transactions, and misuse of the Site.

3. How We Share Your Information

We share personal information with:

  • Service providers who perform functions on our behalf, such as CRM and scheduling software, payment processors, SMS/text messaging platforms, marketing and analytics vendors, and website hosting providers;
  • Advertising and analytics partners — for example, providers of website analytics and search or social-media advertising — who may receive information through cookies and pixels placed on the Site to help us measure and deliver advertising. This type of disclosure may be considered a “sale” or “share” of personal information under Delaware and Maryland law, even though HopeGuard does not sell information to data brokers for money. See Section 9 below and our separate Do Not Sell or Share My Personal Information page;
  • Insurance carriers or adjusters, only where you have asked us to coordinate with them regarding your claim;
  • Professional advisors, such as attorneys and accountants, as needed;
  • Government or regulatory authorities, or other third parties, where required by law, subpoena, or legal process, or to protect our rights, property, or safety, or that of others; and
  • A successor entity in connection with a merger, acquisition, financing, or sale of business assets.

We do not sell personal information to data brokers, and we do not knowingly sell or share the personal information of individuals under 16 years of age.

4. Cookies and Tracking Technologies

The Site uses cookies and similar technologies, including: (a) essential cookies necessary for the Site to function; (b) analytics cookies that help us understand how visitors use the Site; and (c) advertising cookies and pixels that help us and our partners deliver and measure ads. You can control cookies through your browser settings, though disabling certain cookies may affect Site functionality. We currently do not respond to browser “Do Not Track” signals because no common industry standard exists for interpreting them, but where technically detectable we honor recognized universal opt-out preference signals, such as the Global Privacy Control, as required by applicable Delaware and Maryland law.

5. SMS/Text Messaging Program

By providing your mobile number and opting in through a web form, phone call, or text message, you consent to receive text messages from HopeGuard related to quote follow-ups, scheduling, appointment reminders, and service updates. Message frequency varies. Message and data rates may apply. Reply STOP at any time to cancel, or HELP for assistance. Consent to receive text messages is not a condition of purchasing any service. Your mobile carrier is not liable for delayed or undelivered messages. For questions about this program, contact us using the information in Section 12.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to maintain business, tax, warranty, and legal records, and then delete or de-identify it in accordance with our internal retention practices.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, or disclosure. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Children’s Privacy

Our Site and services are not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.

9. Your Privacy Rights by State

Delaware Residents — Delaware Personal Data Privacy Act (DPDPA)

If you are a Delaware resident, subject to certain thresholds and exemptions under the DPDPA, you may have the right to: confirm whether we process your personal data and access that data; correct inaccuracies; request deletion of your personal data; obtain a portable copy of your data; and opt out of the processing of your personal data for targeted advertising, the “sale” of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

Maryland Residents — Maryland Online Data Privacy Act (MODPA)

If you are a Maryland resident, subject to certain thresholds and exemptions under MODPA, you have similar rights to those described above, along with additional protections, including limits on the sale of sensitive personal data and heightened data-minimization requirements for certain categories of information, such as precise geolocation.

Pennsylvania Residents

Pennsylvania does not currently have a comprehensive state consumer privacy law. As a matter of company practice, HopeGuard nonetheless allows Pennsylvania residents to submit the same categories of requests described above, and we will respond on a good-faith basis.

All Site Visitors

Regardless of your state of residence, you may contact us at any time to ask what information we have about you, request corrections, or ask to be removed from our marketing communications.

10. How to Exercise Your Rights

To submit a privacy request, email [email protected] or call (302) 343-1761. We will take reasonable steps to verify your identity before responding. We will respond to verifiable requests within forty-five (45) days, which may be extended by an additional forty-five (45) days when reasonably necessary, with notice to you. If we decline a request in whole or in part, you may appeal by replying to our decision, and we will respond to your appeal within sixty (60) days. If your appeal is denied, Delaware and Maryland residents may contact their state Attorney General’s office.

11. Non-Discrimination

We will not deny you goods or services, charge you a different price, or provide a different level of service because you exercised a privacy right described in this Policy.

12. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last Updated” date above reflects the most recent revision. Material changes will be reflected on this page.
